4. Assumption of Risk & Liability Waiver
- Nature of Activities: By booking with Dirt Road Tours & Transfers, you acknowledge that our expeditions involve inherent risks. These include traveling in high-clearance 4WD vehicles over rugged, unpaved mountain terrain, crossing creeks, hiking on steep or uneven paths, and swimming in natural rivers or waterfalls.
- Voluntary Participation: You explicitly agree that your participation in all tour activities—including trekking, swimming, and off-road transit—is completely voluntary and undertaken at your own risk.
- Physical Fitness: Guests are responsible for ensuring they possess a suitable level of health and physical fitness for their chosen itinerary (ranging from easy/moderate in Navala to moderate/challenging at Mt. Batilamu).
- Release of Liability: To the maximum extent permitted by law, Dirt Road Tours & Transfers, its drivers, local village guides, and community partners shall not be held liable for personal injury, illness, property damage, loss, or delay resulting from natural terrain hazards, weather conditions, or voluntary physical activities during the tour.
- Medical Expenses: In the remote event of an injury in the interior highlands, any medical or emergency evacuation costs incurred remain the sole financial responsibility of the guest. We strongly recommend all travelers maintain comprehensive travel insurance.
